NAIC, Inc./ The Thai Yoga Center, Standard International Training and or Travel Waiver & Agreement
The Native American Indigenous Church, Inc. (NAIC, Inc.), SriPai Tok Sen, Anthony B. James DM(P), ND, MD(AM), The Thai Yoga Center, the specific carrier, or his representatives or assignees, act only as agents in making arrangements at hotels or guest houses and transportation. The participant and undersigned agree that the sponsoring organization and their agents and suppliers shall not be liable for any injury, damage, loss, accident, delay or irregularity, liability, or expense to person or property due to an act of default of any hotel, guest house, carrier, restaurant, company or person providing or rendering any of the services included in the tours. The participant explicitly warrants to indemnify Anthony B. James and his designated representatives both in the US and in Thailand against any loss whatsoever, financial or otherwise, arising from participation in the program as a precondition to participation. The tickets, coupons, tariffs, rules or contracts, and currency used by the carrier, hotel, guest house, restaurant, or other contractor rendering or providing service shall constitute the sole contract between the such provider and the tour member. Participation in potentially risky activities is at the participant’s discretion and responsibility. This includes personal time outside the regular scope and practice of programs and classes.
I understand that any payments made via Bank Wire, credit card, PayPal.Com, or any combination thereof represent a commitment and binding contract to pay according to the agreement, that participant agrees to pay all amounts due in total, and that in the event of cancellation of credit card payment and or filing of “chargeback” claim “r dispute with a credit card company or both, which results in a loss of income, fees, dues or tuitions of any kind to NAIC, Inc., and or Anthony James, that participant will cover and or reimburse this loss entirely, within ten days by cash, certified check or money order. Furthermore, the participant agrees to indemnify all legal and attorney fees about recovering any losses resulting from failure to pay, chargebacks, and reversals of transactions.
Further, the sponsoring organization and or their agents and suppliers accept no responsibility for any damage, delay, irregularity, regularity, or liability arising from pilferage, labor disputes, machinery breakdown, quarantine, government restraints, war, weather conditions, defect in any vehicle of transportation or for any misadventure or casualty, or any other cause beyond their control nor for any additional expenses or damage due to change in advertised schedules or services or any other reason outside of their control. The tour member will bear any losses and costs; the tour rates are only for the period and the laws of the countries in which the accommodations, services, and facilities are rendered. It is the participparticipant’s liability to provide adequate Travel Medical Insurance and Lost Baggage Insurance. In lieu of such insurance, the participant agrees that all liability for loss, medical conditions, or accidents is their entire responsibility. This applies to Covid-19 and other pandemic diseases and local enforcement orders, including “Force Majeure.”
The right is reserved to cancel or change itineraries or substitute services or personnel without notice or explanation and to decline to accept or retain any tour member at any time, before, during, or after completion of this program or any other sponsored and or related program offered by NAIC and or Anthony James and or representatives. Tips and gratuities are customary and are not included. Food and specific types of food are not included except where indicated. Tour members agree as a precondition to participating in the rules, procedures, and guidelines stated or amended by a tour operator (Dr. James or representative) during the trip. Any member failing to do so or who presents difficulty or risk to the goodwill of the venture, or the personal safety of the director or the other participants, at the director’s discretion, will be summarily dismissed from the group without recourse or refund of any kind. Illegal activities are prohibited and will be referred to the appropriate US and Thai authorities.
All rates are based on current tariffs and currency exchange rates in effect at the time of printing and are subject to adjustments in the event of changes therein or changes in the number of participants on which these rates are based as deemed necessary and fair by NAIC, Inc. Specifically regarding Air Fares: as selected, based upon current air tariffs at the time of ticketing, however; fare basis may rise as A) The carrier will not guarantee 100% of the group fare in advance. B) Cost may reflect increases resulting from flight availability and fare basis changes, fuel cost, etc. Should this unlikely event occur, participants are responsible for the increase, if any, and will be notified immediately. Any increases or additional fee or fees shall be limited up to a maximum of no more than 12% of the total original tuition paid by the participant or the actual increase, whichever is lesser. Any balance remaining will be absorbed by the tour provider. Tour providers are specifically exempt and not responsible for airline delays, cancellations, rescheduling, bad weather, acts of God, or aggression by foreign powers.
All tours and programs shown herein may be sold in conjunction with the services of Eva Airways. When issued, the airline’s tickets and coupons in use shall constitute the sole contract between the airlines and tour members and purchasers. The Airlines concerned are not to be held responsible for any act, omission, or event while passengers are not on board their aircraft. Participant agrees to be photographed or videoed during the program for the documentary purpose. Any photos/Videos taken during classes by staff are the exclusive property of Anthony B. James.
As a participant in this program, I understand that these terms are binding, and as an agreement between the providers and myself is a precondition toward my participation in this travel/training program, as previously noted in the offering web page related to this specific program and or programs, once received and reviewed. I have read and understand that without exception, all cancellations and refunds will be based on NAIC Inc.’s pInc.’ sed Cancellation (http://www.SomaVeda.com.Com/naic-cancellation-refund.html) and Refund Policy.
